Construction sites, shipbuilding yards, and road construction sites in New York are the scene of thousands of accidents, injuries, and deaths every year.
Attorneys Howard Cohen, David Elibol and Harry Forrest have years of experience representing the victims of workplace accidents and the families of those who have been injured or have died in construction site and other workplace accidents. As our many verdicts and settlements demonstrate, we have both the ability and experience to successfully prosecute your construction and workplace injury claims for injured workers and their families. We handle legal actions for accidents involving:
Federal and State Oversight
Construction companies are responsible for keeping their worksites safe. In New York State Labor Law sections 200 (safe workplace to work), 240 (scaffold protection), and 241 (6) (industrial code violations) are the primary enforcement laws available to us to protect injured workers and their families. Federal oversight of workplaces, such as by the Occupational Safety and Health Administration (OSHA), provide many regulations and requirements regarding construction sites. Unfortunately, these laws and guidlines are not always met.
When a workplace injury occurs, determining the cause of the injury is the initial step, along with identifying the liable parties. Site owners, managers, contractors, building architects, equipment manufacturers, and insurance companies may be found liable for not keeping construction sites safe.
Examples of Causation
For example, safety training at the site may have been lax or non-existent; site inspections may have been haphazard or not performed; conditions on the site may have been chaotic or uncontrolled. Some 40% of all construction site fatalities involve electrocution. These accidents are preventable — when proper safety procedures and training are in place, and safe equipment is used.
Compensation for a Victim's Losses
Although an employee's injury at a construction site may be covered by workers compensation, this as most workers and families soon learn, is often not enough monetary compensation to truly take care of a worker who cannot work, and almost never does it nearly replace the worker's income that supported his or her family. We can still help you before the Workers Compensation Board to ensure continuing wage and medical benefits while your case is being prosecuted.
Many aspects of a person's life can be damaged or destroyed by a construction or workplace accident, and the injury or death may involve losses such as:
We will be aggressive and thoughtful advocates whose priority is to recover compensation for such damages.
