Wrongful Death

"Wrongful death" is a legal term defined as the death of an individual that was caused by another person or company. The other's act was intentional or it could be reckless or negligent. Howard Cohen, David Elibol and Harry Forrest along with the law firm of Gross Shuman Brizdle & Gilfillan, P.C. has handled many wrongful death cases. We have helped many families through very difficult times to help insure their families ability to continue providing for one another and their children's education. As demonstrated by the list of both our verdicts and settlements, we are both aggressive and compassionate - to stand by you and your family in times of crisis.

Examples of Wrongful Deaths
The following comprise some of the more common causes of wrongful death:

  • Reckless driving, speeding, drunk driving, and other types of vehicle accidents
  • Intentional homicide (murder) and assault
  • Airplane crashes
  • A physician's failure to diagnose a fatal disease, and other forms of medical malpractice
  • A defective product, drug, or machine
  • The failure of a building to conform to code, resulting in a fire or the building's collapse

Compensation for the Survivors
The estate of a person who suffered a wrongful death can file a lawsuit against those responsible for the death. The representative can ask for monetary compensation for the damages and losses that the wrongful death caused. The case may be settled out of court, or it may go to trial.

When a wrongful death claim is settled without a trial, or when a jury or judge finds in favor of the plaintiff (the person who filed the lawsuit, usually a member of the deceased person's family), the settlement or judgment obtained is intended to compensate the plaintiff for having to live without his or her loved one.

Examples of Losses
The compensation in wrongful death cases is usually for losses suffered by a husband or wife, parents, children, or next of kin. Losses may include:

  • Loss of financial support
  • Loss of parental training and guidance
  • Loss of society and companionship
  • Medical, funeral, and burial expenses

If you suspect or you are sure that your loved one's death was a wrongful death caused by the intentional or negligent harm of another, it is advisable that you get legal advice before you sign any documents that concern the death in any way — especially an insurance company's offer of a settlement. At such a difficult and emotional time, having the counsel of an experienced wrongful death attorney will help protect your legal rights and options.
